Coleman Defective Product Case Goes to Trial: California Personal Injury Lawyers to Represent Injured 11-Year-Old

A California Superior Court will hear a defective product case against The Coleman Company starting on Monday, November 2, 2009. Pre-trial issues are being heard today. Trevor seeks compensation for severe and permanent bodily injuries resulting from the use of an alleged defective heater, Coleman's ProCat™ PerfecTemp™ Catalytic Heater (model 5053).

The lawsuit, filed against camping equipment manufacturer Coleman, alleges that the company knew the propane heater was faulty since they had received previous complaints and warranty claims, and knew of other incidents and fires. "In spite of this knowledge, Coleman still manufactured and sold the propane heater, putting profits ahead of people," continued Bisnar.

11-Year-Old Boy Suffers Severe Personal Injury

On December 30, 2005, Trevor Dennis, who was 8 years old at the time, and his parents were camping at the Octillo Wells Desert Recreation area. Early that evening, Trevor retired to their camping trailer, which was being heated by a Model 5053 ProCat™ PerfecTemp™ Coleman propane heater. Later that evening, the heater malfunctioned, which caused the trailer to burst into flames with Trevor inside. Most of the trailer was destroyed and Trevor sustained severe burns. Trevor's injuries require extensive ongoing medical care and have resulted in permanent disabling health issues.

Heater Alleged Unsafe for Indoor Use

"This appears to be a case of a manufacturer using a faulty design, sub-par critical parts and inadequate quality control leading to the catastrophic injury of a then 8-year-old boy," said John Bisnar. The plaintiffs allege that due to excessive heat emitted by the heater into its own internal plastic housing and components, which are combustible at relatively low temperatures, the heater is inherently unsafe for indoor use. The plaintiffs further assert that these plastic components would catch fire in the event of a gas leak from any location within the heater -- including a diaphragm failure -- which, in this case, ignited and led to the catastrophic fire that injured 8-year-old Dennis.

An Orange County Jury to Decide

"Obviously, The Coleman Company does not agree with our allegations that their product is defective," said John Bisnar, "which is why this dispute has been submitted to our justice system for resolution. The two sides to this lawsuit simply do not agree on much. What we do agree on and what both sides believe in is submitting our dispute to a jury of Orange County residents to decide."

Mother's Greatest Concern

Trevor's mother, Alysha Reed, struggles 24/7/365 with providing the constant care that Trevor needs as a result of his injuries. One of her greatest concerns, however, is that another child may be injured from the same heater. Coleman continues to sell its 5053 model heater with the words "flameless warmth outdoors or in spaces like a tent or home" on the box top and photos depicting it working in indoor workshops with the heaters shown on workbench tabletops.

Compensation Sought

The plaintiffs seek compensation for pain and suffering, past and on-going medical care and treatment for Trevor Dennis, and loss of earnings and earning capacity in his adult life. Plaintiffs further seek an award of exemplary damages for Coleman's alleged conscious disregard for the plaintiffs and other users of the heater.

The trial will take place in Department C16, Orange County Superior Court, with the honorable Judge William M. Monroe presiding.
