Counsel Announce Settlement in Uninsured Pricing Class Action Against Scripps Health

SAN FRANCISCO (Business Wire EON/PRWEB ) January 31, 2008 -- Kelly M. Dermody of Lieff Cabraser Heimann & Bernstein, LLP, announced today that the parties have settled a class action lawsuit filed against Scripps Health (Scripps) regarding pricing and collection practices for uninsured patients at its affiliate hospitals. Ms. Dermody is court-appointed lead counsel for the Class.

The settlement, which will be considered for preliminary approval before San Diego County Superior Court Judge Steven R. Denton on February 1, 2008, resolves the Class Representatives and Class members claims against Scripps and its affiliated hospitals.

News Image Settlement Terms

As part of the settlement, Class members will be entitled to make a claim for 35% refunds or deductions from their prior hospital bills for treatment occurring between July 19, 2002 and the date of preliminary settlement approval. Low-income uninsureds may also seek to qualify their past bills for free or reduced care beyond the 35% discount. Scripps has also agreed to maintain compassionate pricing and collections policies going forward, including across-the-board discounts for all uninsured patients, regardless of income; enhanced charity discounts to enable moderate-income uninsureds to receive even greater discounts; financial counseling to uninsured patients to help them qualify for discounted pricing or receive extended payment plans; increased communications to uninsureds about Scripps pricing policies; and limits on collections practices and collections lawsuits. In addition, Scripps has agreed to maintain its uninsured pricing and collections policies going forward for at least four years, among other things. Scripps denies wrongdoing and liability in the case.

Settlement Class

The proposed Settlement Class includes any patient who:

(1) from July 19, 2002 to the date of the Courts preliminary approval order;

(2) received any form of medical treatment as a result of initially presenting at the Emergency Department of a Scripps hospital or affiliate;

(3) were uninsured at the time of treatment; and

(4) did not receive any discount or waiver of the charges for treatment.

Background

This class action originated on July 19, 2006, when uninsured patient Phillip Franklin filed a class action cross-complaint against Scripps Health, a not-for-profit hospital system based in San Diego, after Scripps sued Mr. Franklin through a collection agency. Mr. Franklin was uninsured at the time of treatment. Mr. Franklin alleged that he, like other uninsured patients at Scripps, was charged unreasonable, unconscionable and excessive rates for his treatment. In June 2007, the Court granted the case class action status. The Court also appointed Mr. Franklin as the Class Representative and Lieff Cabraser Heimann & Bernstein, LLP to serve as Class Counsel.

The settlement achieves the goals of the lawsuit: a fair system of pricing for Scrippss uninsured patients during the Class period, and maintenance of policies and practices designed to ensure that this vulnerable population is treated fairly going forward. Case Dropped Today Against Teen Who Innocently Sniffed Teacher's Hand Sanitizing Gel

Middle School Student charged and arrested for using a hand-sanitizer in class. Case dismissed by prosecutors after admitting a mistake was made. Police compare to 'smoking a joint in class' or 'drinking alcohol in class'.

Dallas, TX (PRWEB) January 30, 2008 -- Charges were dropped against the Lewisville teenager that was arrested and charged with sniffing a hand--sanitizer gel.

J. Michael Price II, the attorney for the teenager, was pleased that the Denton County District Attorney's Office did the right thing. "My client and I are very happy that this matter has been resolved successfully. This has been a trying time for him and his entire family the last three months. This matter should have never been prosecuted."

The youth, a student at Killian Middle School in Lewisville, Texas, was accused in October 2007 of 'sniffing' or 'huffing' a common alcohol-based hand sanitizer, "Germ-X" after class. The hand-sanitizer was provided by the teacher for use in the classroom. "My client innocently smelled his hands a few times because he thought 'it smelled good'", Price stated. "The teacher thought he was sniffing it in a manner to try and get intoxicated. The Lewisville Police believed a crime had occurred. He was booked into custody, fingerprinted, a mug-shot taken, then released to his father."

The problem with this case is that under Texas law, the sniffing or inhaling of a hand-sanitizer is not a criminal offense. The law is very clear: Any substance regulated by the Federal Food and Drug Act is not an abusive volatile chemical. Furthermore, a reading of Texas Health and Safety Code Section 485, the law the juvenile is accused of violating, clearly shows that this law is designed for regulated chemical substances, substances that you must possess a permit to sell, or substances that are specifically labeled 'VAPORS HARMFUL' or labeled in accordance with the Federal Hazardous Substance Act. None of these apply to alcohol-based hand sanitizers.

Joni Eddy, assistant police chief in Lewisville, said Friday during a television interview with WFAA-TV, Channel 8 in Dallas, that this is "exactly the same as if the kid was in front of the class drinking alcohol or exactly the same as if the kid was in front of the class smoking a joint." Price notes that both of these acts are specifically against the law in Texas, whereas using or sniffing a hand-sanitizer is not. There are no known cases of anyone becoming intoxicated from the inhaling of alcohol fumes from a hand sanitizer. The only effects from doing this in large quantities are irritated eyes and/or a headache.

The juvenile and his family thought this matter was behind them back in October after he was told the matter would be reviewed by the police department to determine if further prosecution was warranted. He served 5 days of in-school suspension. Up until this incident, the teenager has always been a good student and never had any prior disciplinary problems.

"The troubling aspect of this case is that this matter was reviewed by a supervisor at the Lewisville Police Department, and later reviewed by the Denton County District Attorney's office. It was then assigned for prosecution, a 'Petition of Delinquent Conduct" suit was drafted and personally served against the juvenile and his father on January 22, 2008". Price further stated, "It was only after the threat of this matter becoming public that it was ultimately dismissed. I contacted Ms. Jamie Beck of the Denton County District Attorney's Office and told her I didn't think a law had been violated," Mr. Price said. "She made the appropriate decision without a lot of delay."

Richard Ortiz, the father of the student, told the Dallas Morning News he was pleased with the news that this matter was finally resolved. "I'm glad the DA's office decided they made a mistake, but they didn't decide that until after I hired a lawyer and the media got involved."

“We are pleased that the Oregon Supreme Court recognized this healthy child does not need this surgery and has a right to be heard, though we remain concerned he may have been manipulated,” said attorney John Geisheker, Director of D.O.C. “Nevertheless, this is a landmark step toward recognizing the separate rights of children. We applaud the Court for protecting this boy. There is no more important decision to make for a male child.”

The Court overturned opinions of both the trial court and the Oregon Court of Appeals which had allowed the ritual surgery regardless of the child's preferences. The custodial father, an attorney, claims to have converted to a branch of Judaism which requires the procedure. The mother, an Orthodox Christian, opposed the father and was supported by the Seattle based organization, D.O.C., who submitted two 'friend of the Court' briefs.

A consortium of Jewish groups had supported the father and opposed the mother.

"In our view, at age 12, the (boy’s) attitude regarding circumcision, though not conclusive of the custody issue presented here, is a fact necessary to the determination," Chief Justice Paul De Muniz wrote. "Forcing (him) at age 12 to undergo circumcision against his will could seriously affect the relationship between (he) and his father, and could have a pronounced effect on father's capability to properly care for (him)."

After delay for a possible appeal, the case goes back to an Oregon Circuit Court for the testimony of the child and of experts.
