Childers, Schlueter & Smith Files Suit on Behalf of Worker Injured in Atlanta Botanical Garden Collapse

The walkway, also called a "skywalk," is situated at the Storza Woods section of the world-famous Botanical Garden. Although the walk was slated to open in spring 2009, the accident delayed its opening until April 2010.

Mr. Rios was working as a laborer for a concrete firm on the project. On the morning of December 19, 2008, he and his crew were pouring concrete over the structure frame that had already been erected for the walkway. During concrete pouring, the structure collapsed, killing one worker and seriously injuring 18 others, of whom Mr. Rios was one. The men fell an estimated 30 feet to the damp hillside.

Several other Plaintiffs have also filed suit in the accident, including counsel for the worker who was killed. “It’s difficult to understand why this case needs to be litigated. In fact, the general contractor was fined by OSHA for inadequate shoring towers at the build. However, the erection company faced the stiffest fines for failing to anchor the shoring towers adequately and failing to inspect the supports.
