Marina Del Rey, CA (PRWEB) April 6, 2010 -- L. Tremain, Inc., creators of the Original Butter Bell® crock (http://www.butterbell.com) announced that it has filed a lawsuit in the United States District Court for the Central District of California, Case No. SACV 10-00322 AG (RNBx), against Paula Deen, Paula Deen Enterprises, LLC, and Meyer Trading Company, Ltd., over trademark infringement involving the Butter Bell® trademark and Deen’s appearance on QVC in which she promoted her own product as the Butter Bell® crock.
L. Tremain Inc., claims that Paula Deen “willfully and intentionally” violated the trademark. Paula Deen appeared on QVC on December 15th, 2009 to sell a line of ceramic crocks, which she called “Butter Bell.” L. Tremain registered its Butter Bell® trademark with the U.S. Patent and Trademark Office in 2002, and it has since become incontestable.
“We’ve spent more than 13 years building the Butter Bell® brand and we will aggressively protect it against infringement from anyone or any company,” says Lisa Tremain, president and CEO of L. Tremain, Inc. “For small businesses with limited product lines, your brand and trademark is everything. We believe it’s important to make that known and to let others know they can’t just come in and take that away based on big budgets and marketing power.”
Since its launch in 1997, the Butter Bell® crock which safely keeps butter fresh and spreadable without refrigeration, odors or spoilage, has become the brand leader in butter crock storage products and is sold through numerous channels including gourmet retail outlets, online and on home shopping networks including QVC. The product has been endorsed by top chefs across the country and has been featured on the Food Network’s “Unwrapped” show. As a result of L. Tremain’s extensive use and promotion, the Butter Bell® crock trademark has acquired a favorable and well-known reputation with consumers across the country.
