First victory in hundreds of lawsuits brought against Yamaha for safety problems faced by its Rhino utility-terrain vehicle (UTV)

The Plaintiffs in the case were Roger and Glenda McTaggart. The couple sued for personal injury sustained by Roger, whose left leg was crushed in a low speed rollover incident. Mr. McTaggart was operating the Rhino on a relatively flat, grassy area. During a low speed right turn, the vehicle tipped onto the driver’s side, trapping Mr. Taggart’s leg under the UTV. He sustained serious and permanent injury to his leg.
The State Court of Gwinnett County, State of Georgia jury found that the Rhino was defectively designed and that Yamaha was negligent, securing the first successful verdict against Yamaha relating its Rhino UTV. Given the large number of pending cases in Multidistrict Litigation (MDL), - a proceeding that involves Federal Court Plaintiffs from many jurisdictions - the verdict has far-reaching implications. The first of the cases, MDL No. 2016, United States District Court, Western District of Kentucky, Louisville Division, is scheduled to be heard October 18, 2010.
