Robert Billar, highly regarded Phoenix criminal defense attorney, persuades jury to acquit after five-day trial in Superior Court of Arizona
Phoenix, Ariz. (PRWEB) May 28, 2010 -- Attorneys from the law office of Billar & Donald, P.C., a prominent Phoenix-based criminal defense law firm, secured an acquittal for their client, Cory Marshall, in a one-count armed robbery case stemming from a 2009 incident in Maricopa County.
The case, State of Arizona v. Cory Deshawn Marshall (CR2009-147703-003 SE), was tried in the Superior Court of Arizona for Maricopa County. It originated as an armed robbery felony indictment, in which the Maricopa County Grand Jury alleged that Marshall "used threats or force" against Brent Paris in the course of taking property from Paris on July 11, 2009. The Maricopa County Attorney prosecuted Marshall, alleging that he had committed a "dangerous felony" because the offense involved the use of a deadly weapon.
After a five-day trial earlier this month, an eight-person jury deliberated just five hours before returning a unanimous verdict of not guilty for Marshall in the case.
"We're very pleased with the jury's verdict in this case and are delighted that Mr. Marshall can return to a normal life, without the fear of a lengthy prison sentence hanging over him," said Robert Billar, founding partner of Billar & Donald and the lead defense attorney in the case. "Charges of violent property offenses, such as armed robbery, involve very serious legal issues and we were confident that the jurors would acquit Mr. Marshall once we laid out all of the facts in the case."
Billar & Donald, P.C., helps their clients by ensuring that their rights in the Phoenix criminal law process are protected and maintained. In criminal court, the prosecution must prove guilt beyond a reasonable doubt, so elements of action and mental state must be proved. The criminal defense lawyers at Billar & Donald work to challenge the prosecution's case against their clients under both elements.
