Mr. Fleischer has more than 30 years of experience litigating cases across multiple industries and areas of law. At Haynes and Boone, he will concentrate on high-stakes business litigation in the entertainment, real estate and bankruptcy areas. David was previously a partner in the New York office of Paul Hastings.

“David is a seasoned litigator with invaluable knowledge of the New York business community,” said Kenneth Bezozo, the firm’s New York managing partner. “His trial experience enhances our capabilities in key areas, including financial restructurings, real estate restructurings and bankruptcies. David is an ideal fit for our team and exemplary of our focus as we continue to expand in New York.”

Mr. Fleischer was impressed with Haynes and Boone’s reputation and goals for New York. “Haynes and Boone has more than 200 litigators nationwide doing very high level work that complements my own,” he said. “I look forward to integrating my practice and taking advantage of the full resources of the firm to benefit my clients.”

Just last week, on behalf of Marvel Entertainment, Mr. Fleischer secured dismissal of a lawsuit seeking more than $750 million in damages and other relief. The would-be derivative plaintiffs in that action claimed that Stan Lee signed over to Stan Lee Media, a now defunct company with which Mr. Lee is no longer affiliated, rights to iconic characters he created while employed by Marvel, including Spider-Man, Ironman and The Incredible Hulk. Manhattan federal district court Judge Paul Crotty held that the plaintiffs lacked standing, had filed claims barred by the statute of limitations, and failed adequately to plead legally sufficient claims.

“David successfully defended his client against a complex mix of 13 federal and state claims ranging from copyright and trademark infringement to right of publicity violations,” said David Harper, partner and chair of Haynes and Boone’s Intellectual Property Litigation Section. “His experience handling this type of lengthy, high-stakes dispute deepens our capabilities and further raises our profile as a go-to firm for businesses facing major litigation.”

In his practice, Mr. Fleischer represents clients in a wide range of controversies, including commercial litigation matters, consumer class actions, intellectual property and contract disputes, real estate litigation, governmental investigations, bankruptcy and creditors’ rights and corporate governance. He regularly appears in state and federal courts as well as arbitration and mediation forums throughout the United States.
