Fashion Designers Use Law Article to Understand Intellectual Property -- While Piracy Prevails

Attorney’s review of design patent, trademark, and copyright garners praise from fashion designers.

New York, NY (PRWEB) January 20, 2010 -- The Law Office of David H. Faux recently authored “Elite Knock-Offs and Nascent Designers,” published by the New York University School of Law. This article frames the current rights of beginning fashion designers while arguing for increased copyright protection for designs. In February, David Faux will give a talk at Parsons the New School for Design based in part on this paper.

[This article] was exactly in line with the struggles fashion designers have been faced with.
“Every designer knows a colleague whose designs were either ‘borrowed’ or blatantly pirated by one of the larger fashion houses,” explained Dave Faux, sole proprietor of the law office. “They wanted to know about counterfeit protection at their level, when they are already frazzled from preparing for a upcoming season."

The article goes through copyright, trademark, and design patent options in a manner accessible to the non-lawyer. It also reviews current trends in fashion protection such as the Design Piracy Prohibition Act and the “Piracy Paradox.”

Designers have responded with such comments as, “Thank you for speaking out for independent designers,” “[This article was exactly in line with the struggles fashion designers have been faced with,” and “Every designer should read this to know the basic limits of her rights.”

Versions of the Design Piracy Prohibition Act are currently pending in the Senate (S. 1957) and the House of Representatives (HR. 2033).
