Third Mediation Masterclass Takes Place In Manchester

Halliwells, a leading law firm from Manchester hosted the third ADR Group mediation masterclass on the 16th of December. The end of year masterclass is the latest in a series of masterclasses aimed at bringing professional mediatiors together to share experience, best practise and to discuss topical issues concering both commercial and civil mediation.

The end of year masterclass is the latest in a series of masterclasses aimed at bringing professional mediatiors together to share experience, best practise and to discuss topical issues concering both commercial and civil mediation.

The intention of the mediation masterclass is to create an active forum for practising professional mediators to share their working experiences and practises for the benefit of all. Many mediators facilitate cases with little opportunity to reflect on all the decisions made during the practical application of mediation. The masterclass provides peer to peer feedback and constructive criticism.

The shift to rights-based, private claims should, on the face of it, provide a rich field for mediation as an effective means of conflict resolution.

The event chair, Quentin Smith, a ADR Group mediator who has successfully worked on over four hundred commercial disputes was instrumental in co-ordinating the events discussions and provided a very useful key do's and dont's list. These were do; prepare, engage early, busk, maintain momentum and persevere. The dont's were; have a game plan, play a role, get lost in detail, lose focus and don't lose sight of the decision makers.

Eve Pienaar, an ADR Group mediator who specialises in commercial mediation explains the purpose of mediation with regards the workplace environment: "Over the past quarter of a century we have witnessed a shift in terms of workplace conflict, from collective expression of conflict (strikes and industrial action) to individualised claims in the Employment Tribunals. The nature of conflict has also changed, broadly from disputes over pay and terms to claims based on infringement of individual worker’s rights. This shift to rights-based, private claims should, on the face of it, provide a rich field for mediation as an effective means of conflict resolution, particularly on the workplace front, before the employment contract has come to an end."

The ADR Group aims to participate in this and other similar continuous development programmes that provide the opportunity for best practise and standards to be at the cutting edge of quality. This the third Masterclass to take place in 2009 was very enthusiastically received by the attending mediators as were previous sessions taking place in London and Bristol. For interested parties further sessions are planned to take place in 2010 and are only available to ADR Group members.
