The case, Ross v. City of Asbury Park (Docket No. A-0379-08T3), originated when Shebell & Shebell filed a complaint with the New Jersey Department of Labor's Division of Workers' Compensation in behalf of Lori Ross, an employee of the City of Asbury Park. Ross alleged that she was subjected to a hostile work environment at the City during the time she worked for the office of the city manager from 1998 to 2005.

"After a trial, the workers' compensation judge (Judge Leslie Berich) found that petitioner-employee Lori Ross had suffered compensable mental stress as a result of prolonged exposure to a hostile work environment," wrote the Appellate Court of the Superior Court of New Jersey. "We affirm because the judge was entitled to conclude from her findings, which were supported by credible evidence, that petitioner was subjected to objectively stressful working conditions."
