New Hope Software, Inc. These changes affect all lawyers practicing consumer and business bankruptcy.
Seattle, WA (PRWEB) September 14, 2009 -- New Hope Software, Inc., a leader in providing bankruptcy software for attorneys since 1991, announced today the release of Build 739 of Bankruptcy2009 that supports the latest version of the courts' CM-ECF software.
Bankruptcy courts all over the country are in the process of installing and releasing their latest version of CM-ECF - 3.3.2. With this new version the courts are now requiring that attorneys certify at login that they have read and will comply with Rule 9037 of the Federal Rules of Bankruptcy Procedure. This rule lays out a number of privacy requirements that attorneys must follow, including the redaction of Social Security Numbers, account numbers of various types, and the names of minor children.
While bankruptcy courts require a full Social Security Number to file a case electronically, Bankruptcy2009 will automatically redact them when printing or making a pdf. In addition, all account numbers on the debtors' schedules can be automatically redacted as well. While the names of minor children are used within the program to assist the user in identifying minors for data entry purposes, all such names are automatically excluded from the Official Schedule I.
CM-ECF is the court created and supported software that is used for the courts' electronic filing and case management system. While all documents are in pdf format, CM-ECF also manages a database for calendaring, noticing, and tracking filing deficiencies. The current CM-ECF system is now undergoing initial reviews for a next generation replacement. Having been in use for nearly 15 years, CM-ECF is now showing its age and the court is already taking suggestions and comments from users and stakeholders for its replacement. Originally designed for a single asbestos civil case in the mid 1990's, not the data driven world of bankruptcy, CM-ECF has grown in a chaotic and ad hoc manner. However, this time, with the experience from thousands of users and millions of cases, a replacement for CM-ECF promises to be a vastly improved product.
Ten years ago New Hope was instrumental in the development of the courts current "case upload" system and at that time was the only petition software used in all of the prototype ECF courts. Having participated in various other experimental forms of electronic filing since 1992, including the courts own EDI system, New Hope has made a commitment to fully support any future replacement for CM-ECF.
