Maine Superior Court Enjoins Scott Health & Safety from Terminating Verrill Dana Client Fire Tech as a Distributor of Scott Products
Portland, ME (PRWEB) July 23, 2009 -- On June 17, the Maine Superior Court (Justice Nancy Mills) granted an injunction for Verrill Dana client, Fire Tech & Safety of New England, Inc. ("Fire Tech"). Specifically, the court enjoined Scott Health & Safety, a subsidiary of Tyco International, Ltd., from terminating Fire Tech as a distributor of Scott products and ruled that Fire Tech was likely to succeed on its claims under the Maine Franchise Laws for Power Equipment, Machinery and Appliances and the Maine antitrust laws (Maine Superior Court Docket # CV-09-159; Fire Tech & Safety of New England, Inc,. v. Scott Technologies, Inc. d/b/a/ Scott Health & Safety).
Scott is a manufacturer of respiratory and other personal protective equipment and safety apparatus for fire and rescue services. The Scott product line includes self-contained breathing apparatus, supplied air and air-purifying respirators, gas detection instruments, thermal imaging cameras, air compressors, and accountability systems. Since 1985, Fire Tech has been an authorized distributor of Scott Health & Safety products in the territories of Maine, Massachusetts, New Hampshire and Vermont. On March 31, 2009, Scott announced that it was going to terminate its distributorship relationship with Fire Tech. On May 21, Verrill Dana filed the action and moved for a temporary restraining order and/or preliminary injunction.
