Senate Bill 94 Threatens Citizens' Rights Even While It Claims to Protect Them

According to United Law Group, the ambiguous language of SB 94 jeopardizes the rights of honest citizens to seek counsel in matters pertaining to foreclosure prevention and litigation. Authored by Senator Ron S. Calderon, chairman of the banking finance and insurance committee, this bill claims to protect consumers from being taken advantage of by predatory loan modification companies and others. In practice, SB 94 will unfairly penalize minorities and the underprivileged, who not only have a constitutional right to representation, but need it in order to deal with seasoned, professional bank negotiators says the group.

Legal foreclosure prevention services, on the other hand, offer a genuine service to the consumer according to the group. These services also pose a significant threat to banks.
