Attorney Carol L. Schlitt Wins $300,000 in Manhattan Construction Accident

Schlitt has announced that she negotiated a $300,000 settlement with Felix Associates, a major New York construction firm, for damages in a construction accident caused by an unsecured roadway plate that crushed a man's foot. During a lunch break on a warm June day in 2006, Phil DiPaolo and a friend walked south on the pedestrian mall on Nassau Street. When they reached Maiden Lane, the two men waited for traffic to clear and then began to cross the street. A truck driving along Maiden Lane caused an unsecured metal plate in the roadway to lift and fall onto the Mr. DiPaolo's foot, crushing it and pinning him to the roadway. He suffered multiple fractures to his right foot and toes, injuries that required two surgeries.

Ms. Schlitt explained, "The initial challenge came in identifying who owned the roadway plate and who was responsible for securing it." That work involved sifting through records with the City of New York and Con Ed. "Once we knew that Felix had responsibility for the plate, we built a compelling case using a combination of investigative techniques and legal research."

Ms. Schlitt pressed for an early settlement. "We had such a strong case that it was in everyone's best interest to settle early and to pay my client a just amount for his injuries." Mr. DiPaolo said, "It is quite a relief to have it over."
