The case involved civil rights claims as well as claims of medical malpractice.
On May 20, 2010, Long Island’s Newsday printed an article entitled “Judge Allows Lawsuits vs. Police in a Man’s Death.” The article explained that, “A pair of lawsuits charging Southampton Village police using stun-guns killed a man in 2004 will go to trial after a federal judge refused to throw out the suits.”
The article further declared that, “U.S. Magistrate William Wall in Central lslip last week declined to issue summary judgments requested by attorneys for Southampton and stun-gun manufacturer Taser International, Inc., of Scottsdale, Ariz., who were named in separate multimillion-dollar suits filed by the family of David Glowczenski of Southampton.”
Glowczenski, 35, died February 4, 2004, during a confrontation with Southampton police after his family called 911 and said he was acting irrationally. Four officers shocked Glowczenski nine times with stun-guns, shot him with pepper spray, ‘hogtied’ him and choked him.”
The article concluded by saying, “Southampton Mayor Mark Epley said the Southampton Village Volunteer Ambulance Corp. and several volunteers who treated Glowczenski were removed from the suit by the judge.”
