Accident reconstruction and engineering firm, ATA Associates has been hired by Houston law firm, Collins & O’Neal, to consult in a Toyota Camry accident that resulted in two fatalities. A $100 million wrongful-death suit has been filed in Galveston’s 122nd District Court by Wayne Collins against Star Toyota, Toyota Motor Sales U.S.A., CTS Corp. and Gulf States Toyota.

A $100 million wrongful-death suit has been filed in Galveston’s 122nd District Court by Wayne Collins against Star Toyota, Toyota Motor Sales U.S.A., CTS Corp. and Gulf States Toyota.
Driver Janice Berg and husband, Kenneth Berg Sr., died when Berg lost control of her 2009 Toyota Camry and crashed into a utility pole at an intersection in Clear Lake City, Texas. The lawsuit, filed February 15th by Collins on behalf of Berg’s son, Kenneth Hall, claims the car malfunctioned and accelerated at a high rate of speed.
According to Collins, “Toyota has been aware of problems and a spike in complaints of sudden acceleration problems for several years, possibly as early as 2004. Toyota chose not to act nor share this information with the public or Toyota owners. With their backs against the wall, in 2009 Toyota blamed driver inattentiveness and then floor mats for sudden, uncontrollable acceleration. Ignoring the intrinsic defects with its throttle system and blaming the floor mats saved Toyota $100 million dollars -- at the expense of human lives.”

According to ATA CEO Bob Swint, “While this case is in its infancy, ATA started investigating sudden acceleration issues in Audis in the late 1980s, followed by Jeep Cherokees in the 90s. We began to see a trend of unexplained accelerations in Toyotas in the early 2000s. Like everyone else, we are curious to see if Toyota is going to identify a real fix for this ongoing problem.”
