Gallagher Keenan Obtains $500,000 Settlement for ConArt, Inc. in Dispute with Florida Hotel Companies

Tampa law firm prevails in counterclaim against three plaintiffs who had filed lawsuit against ConArt as part of business dispute over work done on hotel construction projects

Tampa, Fla. (Lexis Nexis/PRWEB ) December 2, 2009 -- The Tampa-based law firm of Gallagher Keenan, P.A. recently completed the settlement of a two-year legal dispute that resulted in a $500,000 award for the firm's client, ConArt, Inc.

ConArt, a Georgia-based precast concrete manufacturing company, had been contracted to provide materials that were to be used in three separate hotel construction projects in Florida. In 2007, the hotels filed an arbitration claim against ConArt, seeking combined damages in excess of $1.5 million for various breach of contract and performance complaints.

ConArt retained J. David Gallagher and Michael P. "Mickey" Keenan, of Gallagher Keenan, PA for their extensive experience in complex business litigation in general and construction litigation in particular. Gallagher Keenan responded to the claim and filed a counterclaim for approximately $440,000 in alleged financial damages to ConArt.

In 2008, the matter went before a three-person arbitration panel. After a three-week hearing, the arbitrators unanimously declared ConArt to be the prevailing party in the case.

The plaintiffs sought to vacate the arbitration award in Florida State Court, but Gallagher Keenan successfully prevailed on its motion to dismiss. The case, Laxmi Augusta National Hotel II, Ltd., Laxmi Augusta National Hotel III, Ltd., Spanish Springs, Ltd. v. Conart, Inc. (Docket No. 08-CA-26752), was filed in the Ninth Circuit, Orange County, Fla. Complex Business Litigation Court. The parties then entered settlement negotiations, which ultimately resulted in a $500,000 payment to ConArt.
