Jury of 9 Women, 3 Men Return Verdict in First CTA Derailment Case to Go to Trial; Lead Attorney Jeffrey J. Kroll Explains Result
Chicago, IL (PRWEB) December 14, 2009 -- A $135,000 verdict has been delivered in the first case to go to trial stemming from the Chicago Transit Authority train derailment in July 2006.
Eduardo Martinez of Chicago alleged that he suffered psychological injuries including post-traumatic stress disorder due to the derailment of a CTA Blue Line train on July 11, 2006. Martinez was riding in the eighth car of the Blue Line train when the car derailed in the tunnel between the Clark and Lake Street station and the Grand and Milwaukee station in Chicago.
A jury of 9 women and 3 men returned the verdict Monday afternoon."This verdict demonstrates that the jury understood and appreciated the anxiety my client has experienced and will continue to experience," said Martinez's attorney Jeffrey J. Kroll of the Law Offices of Jeffrey J. Kroll. "Mr. Martinez has tried to get back to his life after this incident, returning to work less than a week after the derailment and still riding the same train every day as it is his only means of transportation."
Kroll said this ruling speaks volumes as to the stress Mr. Martinez went through during the past three years and the years to come. Kroll said, "It is notable that $120,000 of the verdict was for Mr. Martinez's pain and suffering already experienced and reasonably certain to be experienced in the future." Of the remaining amount, $14,000 was for the victim's medical bills and $1,000 was for lost wages.
