This recent win has its roots in an action that was settled in August 2006 between a property developer in Flushing, Queens and a former business partner. The settlement agreement imposed financial obligations on both parties, and each party subsequently claimed that the other had breached the agreement. In December 2007, the former business partner attempted to gain the upper hand when he obtained a judgment of nearly $2 million against the Flushing-based developer by filing a document that he claimed was a confession of judgment signed by the developer. Armed with the resulting judgment, the former partner froze the developer's bank accounts and began collecting on the judgment. The Law Office of Michael C. Rakower, P.C. was hired to represent the developer.

"We took a look at the judgment and the papers supporting it and realized that the judgment never should have been granted," says Michael Rakower, a principal of the boutique litigation firm in New York that bears his name. "The so-called confession was not valid. Once we exposed the truth, the court reversed itself and ordered the investor to pay back the money he took from our client." Overturning the judgment was 'tricky'," says Rakower, who explained that courts are reluctant to reverse themselves. "We worked extremely hard to develop our case and make it as clear as possible for the court. We are very pleased that the court carefully examined the issues before rendering its thoughtful decision."

Rakower offered high praise for attorneys Harvey Stuart and David Miller, who "did excellent work in probing the law and honing our client's case for the court."
