Axiom Worldwide Convicted of Infringing a Hako-Med Patent

A federal jury in Tampa Florida returned a verdict in favor of Hako-Med finding that Axiom Worldwide willfully infringed Hako-Med's Horizontal Therapy patent and awarded damages(United States District Court, Middle District of Florida Case No.: 8:06-cv1790-T33AEP). In addition, the federal court issued another permanent injunction against Axiom Worldwide barring all EPS 8000 devices manufactured prior to November 28th 2006.

A day earlier a federal judge in the United States District Court, Middle District of Florida, Tampa division, the honorable Virginia M. Hernandez Covington, made a temporary injunction against Axiom Worldwide permanent thereby baring Axiom Worldwide from using one of Hako-Med's trademarks.

Axiom Worldwide, based in Tampa Florida, manufactures spinal decompression devices as well as a pain management device, which was found to infringe on Hako-Med's unique patented pain therapy. Axiom Worldwide's head-engineer further admitted under oath that Axiom had done no validation through published clinical studies on their EPS 8000 devices prior to marketing the unsubstantiated claims to physicians that the EPS8000 devices "presents a breakthrough in electrical stimulation therapy" and "the most advanced Electrical Nerve stimulation available today."
