Slutsky Family Files Civil Lawsuit Against Fairy-Tales Daycare Center in Penndel PA for Death of Two-Year-Old Son

Weinstock announced today that a civil lawsuit was filed July 21, 2009 on behalf of Mr. and Mrs. Slutsky (Case ID: 090702565, First Judicial District of Pennsylvania, Court of Common Pleas) for the wrongful death of their two-year-old son Daniel against the owner of a daycare center. The complaint says that Daniel was left locked and unattended in the back of a Toyota Sienna Minivan with the windows closed for more than six hours.

According to the allegations in the Slutsky vs. Shvartsman, et al complaint, the daycare center owner, Rimma Shvartsman, forgot Daniel was in the back seat of her minivan on a day when it was more than 80 degrees. By the time Daniel was discovered in the vehicle at the end of the day, the efforts to revive him were unsuccessful. He was pronounced dead at Saint Mary's hospital upon arrival.

Weinstock says statistics suggest as many as 43 children died as a result of vehicular hyperthermia last year in the United States. At the time of this press release, 19 children, including Daniel Slutsky, already died this year of hyperthermia after being left in the backseat of a car.
