California Personal Injury Lawyers File Wrongful Death Suit Against City, School District and SUV Driver

Filed on behalf of Hyangsook Jung, the deceased's court appointed guardian, the suit alleges that on the morning of November 26, 2008, Conrad Pantig Maglonzo negligently and recklessly drove his 1992 Nissan Pathfinder over the curb of Maple Hill Road and onto the sidewalk, striking and killing then five-year-old Michelle Kwon and severely injuring Christine and Soonil Kwon.

A Cascade of Chaotic Events

Plaintiffs allege that acute traffic and parking problems around the elementary school--caused by unstaggered, single session school hours--necessitated the arrival and attendance of the entire student population and staff within one hour before 8 am. This resulted in too many cars and SUVs competing for too few parking spaces along Maple Hill Road. In an attempt to remedy this, Maple Hill Elementary school used traffic cones to block parents' vehicles to a semi-circular driveway. Blocking this driveway created a hazardous increase in traffic as parents scrambled to drop students off in the safest available area. One of those parents was Maglonzo, who, plaintiff's lawyers claim, accelerated, driving up the curb in a frantic attempt to cut into a just-vacated curbside parking spot.

No Crossing Guard, No Safety Trails or Barricades

Bisnar | Chase allege that WVUSD and Diamond Bar were aware of these conditions, and that they also possessed the resources to prevent such a tragedy. Yet no crossing guards were provided to control the safe and orderly discharge of children that morning. Furthermore, neither WVUSD nor Diamond Bar had prepared any safety trails or barricades along the sidewalk next to the school property.

Compensation for Multiple Damages Sought
