CA Civil Code Section 1632 is an often over-looked law that requires banks and lenders to provide contracts in the borrower's native language. Having received a number of complaints from citizens facing foreclosure, the firm is pursuing cases where lenders violated the borrowers' rights.

This often-overlooked piece of legislation requires that contracts be written in the same language in which they were negotiated.
"With over 12 million Californians speaking a language other than English, the number of people who were taken advantage of by predatory brokers and lenders is staggering," said Sean Rutledge, Managing Director for United Law Group. "We've received a large number of complaints from borrowers facing foreclosure who were not issued contracts in their native language and we are responding to the cry for help."
California Civil Code Section 1632 requires that any person engaged in a business who negotiates primarily in the a language other than English, either orally or in writing, deliver to the other party a translation of the contract or agreement, before it is executed. The translation must include every term and condition in the contract or agreement.
"The law was put in place to protect people from being victimized by unscrupulous individuals and institutions," said Rutledge. "Unfortunately, very few brokers bothered to comply with this law. United Law Group made a commitment to help people facing a foreclosure action to enforce their rights in this area."
With this campaign United Law Group is helping those whose rights were violated at a time when hundreds of thousands are facing a foreclosure action.
"The law clearly states that if a contract is negotiated in a foreign language, such as Spanish or Vietnamese, then the loan documents and other contracts must be in that language," said Rutledge. "Many of the people in foreclosure are there because they did not clearly understand what they were signing. They were explained the benefits of the loan in their native language but were not given the opportunity to review the documents they were signing."
