Orange County, CA (PRWEB) March 24, 2009 - Chrysler Corporation is being sued by Jasmine Ronice McMillon-Smith for allegedly manufacturing and selling defective Jeep Cherokee parts that caused her several severe personal injuries, including permanent brain damage according to court documents. National automobile defect law firm Bisnar Chase is representing McMillon-Smith. The case was filed in the Superior Court of the State of California, Alameda County, Case #08424047.
According to court documents, on June 9, 2007, McMillon-Smith was a passenger in the rear seat of a 2004 Jeep Cherokee when it was stopped southbound on Interstate 238 in Hayward, CA. She was properly restrained by seatbelt and shoulder harness. While stopped, the 2004 Jeep Cherokee was struck from behind by a 2000 Chevy Silverado. The impact broke McMillon-Smith's seat and propelled it backward, causing her body to submarine under the seatbelt and shoulder harness restraints until she hit her head at the back of the 2004 Jeep Cherokee. This blow caused McMillon-Smith serious injuries, including brain damage.
According to court documents, Chrysler knowingly manufactured and sold defective seats and restraining systems. McMillon-Smith is suing for special and economic damages including but not limited to medical expenses, past and future; loss of earnings and loss of earning capacity; past and future non-economic losses for pain, suffering and emotional distress, punitive damages and legal costs.
"For just a few dollars, Chrysler could have spared Ms. McMillon-Smith her current and future agony," said Brian Chase, partner at Bisnar Chase. "Now her life is permanently altered, all because Chrysler was unwilling to put the bests interests of consumers like Ms. McMillon-Smith ahead of its profit margin."
