Sugar Plum Fairy Baking Company has Been Sued for Non-Payment of Overtime Wages and Other Labor Code Violations

The lawsuit alleges that defendants had devised a plan whereby they would pay their employees with two checks. One of the checks would cover all the hours worked up to 40 hours and had the proper deductions as mandated by State and Federal law applied to it, the second check which had no deductions would cover any hours worked over 40 hours a week. However, the second check would pay the employees "straight" time as opposed the mandated time and half for over time.
