On May 19, 2008 a Bronx Supreme Court jury found the dumpster company and the driver of the car liable for the accident. The case (number 24368/02) involved a Bronx car accident that occurred on December 14, 2001 when Mr. Smalls rode as a passenger in a car driven by Jhakim Jenkins. Mr. Jenkins made a left-hand turn from Randall Avenue onto Zerega Avenue and struck a parked dumpster owned by AJI Industries, Inc. Mr. Smalls suffered fractures to both fibulas, an ankle and his left humerus that required multiple surgeries and brought suit against both Mr. Jenkins and AJI Industries.
During the course of litigation, the owner of the dumpster sought summary judgment dismissing the case against the company. That motion wound up before the Court of Appeals, New York State's highest court. Ms. Schlitt argued the appeal before the Court of Appeals and won when the court issued a unanimous decision in her favor. With the appeal settled, the matter proceeded to trial in State Supreme Court in the Bronx.
The attorney for the dumpster argued that the accident resulted solely from the driver's inexperience. Ms. Schlitt produced New York City Highway and Transportation regulations that showed the defendant had failed to properly place the dumpster and failed to equip it with reflectors. "This was an accident waiting to happen and the defendant's lawyer tried to blame the victim," explained Ms. Schlitt. She added, "Companies cannot use the streets of New York to line their pockets while putting citizens at risk."
