According to the Florida Highway Patrol, the crash happened at 7:15 a.m. Monday just south of Hypoluxo Road. Gonzalez was taking her son to daycare when her car collided with a tractor-trailer and David was thrown from his child safety seat and sustained head injuries that proved to be fatal. He died late Tuesday at Delray Medical Center.
“Though the initial police investigation indicated that our client, Gabriel Lopez Gonzalez, may have been at fault for the death of her 3-year-old son, the firm of Steinger, Iscoe & Greene has agreed to represent Ms. Gonzalez during the most difficult time of her life,” explained Gary Iscoe, co-founder of Steinger, Iscoe & Greene.
“The firm's preliminary investigation into this tragic death has indicated that in fact Ms. Gonzalez was not at fault,” Iscoe continued. “The scene investigation and witness statements point to the other driver merging lanes into Ms. Gonzalez’s vehicle. Additionally the seat belts or child restraints may have failed, thus contributing to this tragic death.”

A wake has been scheduled for 3-year-old David today, Nov. 8, from 6 to 8 p.m., at Scobee Combs Bowden Funeral Home in Boynton Beach; his funeral to be held tomorrow, Nov. 9, at 2 p.m. at the same location.
