In case numbers 06-22534 and 06-17481 the applicants were denied Security Clearance under Guideline G and Guideline J (respectively). The Government argues that excessive alcohol consumption and criminal activity create doubt and raise concerns about an individual's reliability and trustworthiness. The applicants in these particular cases sought the assistance of Attorney Alan Edmunds to mitigate these concerns.
At both hearings Attorney Edmunds called numerous witnesses to testify on behalf of the applicants. Volumes of exhibits were submitted into evidence to be considered by the Administrative Judge. Even the Applicants testified on their own behalf.
Although the Government argued that it was not in the best interest of the United States to grant clearance to these applicants, Attorney Edmunds argued that the allegations contained in the Statement of Reasons under Guideline G and the allegations under Guideline J should not be sustained and that the inference is strongly overcome by the presentation of evidence. Upon considering the evidence and the statements of counsel, the Administrative Law Judge found in favor of the Applicants for each and every allegation raised in the Statement of Reasons.
