Twenty-five senators were absent and did not vote, including McCain (R-AZ) and Feinstein (D-CA).

132 members of the House of Representatives were absent and did not vote; Pelosi (D-CA), Kaptur (D-OH), and Strickland (D-OH) voted to accept Ohio's votes.

The jury awarded $3 million for Mr. Rosenberg's pain and suffering and $1 million to Mrs. Rosenberg for loss of services and society. Mr. Rosenberg developed mesothelioma during his retirement while living in New Jersey. He died at the age of sixty-four.

The Casale case (Joseph and Dolores Casale, Index No. 104299/06), involved the asbestos exposure of Mr. Casale during his career as a steam fitter (also known as pipe fitter) in New York. At the time, steamfitters were unknowingly endangered with asbestos exposure in their workplace due to asbestos being used on equipment such as valves, steam trap and boilers. While still a teenager Mr. Casale worked at shipyards, including the Brooklyn Navy Yard, as a member of the Local 638 Union. Mr. Casale continued in the same union and worked in the steam fitter trade at job sites in New York City throughout the 1960s and 1970s. Mr. Casale later moved to Florida but his mesothelioma diagnosis was linked to his asbestos exposure which occurred in New York. Mr. Casale was exposed to asbestos from various products including valves and steam traps, from both internal asbestos components and asbestos insulation that was applied to the products.

The jury awarded a total of 5 million dollars in the Casale case: 1.5 million for Mr. Casale's pain and suffering up to the date of the verdict; 1.5 million for Mr. Casale's future pain and suffering; 1 million for Mrs. Casale's loss of service and society up to the date of the verdict; and 1 million for Mrs. Casale's future loss of service and society.

In the Casale case, the New York jury returned a verdict in favor of the Casales against a manufacturer of valves, as well as a manufacturer of steam traps. This represents the first verdicts involving valves and steam traps in the history of asbestos exposure litigation in New York, and is reportedly the first asbestos verdict in the nation involving the use of steam traps.

Mr. Casale, who is living with mesothelioma at age of 66, testified at trial.

NBC's Oxygen Network Fails in Bid to Get America's Hot Musician Lawsuit Dismissed

NBC's newly acquired Oxygen Network lost its first battle in federal court this week against American Youth Symphony (AYS), producers of America's Hot Musician, to have the case dismissed.

Washington, DC (PRWEB) January 3, 2008 -- NBC's newly acquired Oxygen Network lost its first battle in federal court this week against American Youth Symphony (AYS), producers of America's Hot Musician, to have the case dismissed.

The suit (case no.1:07-cv-01280) which will be fought in the U.S. District Court for the Southern District of New York, had been stalled for about three months pending the court's December 31st ruling.

According to court records, at issue is that Oxygen, owned by Oprah Winfrey at the time of the filing, issued a cease and desist letter demanding that AYS refrain from using Oxygen's name in advertisements for America's Hot Musician, a paid program which was to debut on the network on July 7, 2007. AYS contends that Oxygen effectively canceled the program and frustrated its agreement by such a demand because AYS could not reasonably promote its paid program to advertisers and fans without being able to state where the program was airing.

Television shows are typically produced and promoted by the networks themselves but many networks also sell their airtime in half hour blocks to independent producers for productions such as religious broadcasts and infomercials.

In a statement, AYS artistic Director Gregory Charles Royal said: "This whole scenario is so ridiculous to think that any person with common sense would even think they could sell someone real estate and expect them not to tell their customers what address the building is on. Then to add insult to injury, Oxygen's original attorney threatens us with countersuits and full court onslaughts by the all powerful NBC attorneys. We just want to settle the matter and suggest that in the future, Oxygen accept the inherent price, like other stations do, for making a profit from selling paid program time or stop selling it".

"Musician", which has been shot all the way through to the semi-final round, features solo instrumental musicians vying for a one-year recording contract, and currently airs as a broadband television program on its www.americashotmusician.org website and on iTunes with voting set to begin January 9th.

The program offers a true musical dialogue between contestants and the judging panel that includes violinist Marissa Regni from the National Symphony Orchestra, former Kittie bassist Talena Atfield and Royal, a Duke Ellington Orchestra alum and trombonist from the Broadway musical Five Guys Named Moe. Starbucks is being sued for trespass and Java alleges that Starbucks' representatives entered its Gloria Jean's Coffee Store to damage and/or destroy Plaintiffs' business.

The lawsuit, entitled Create-A-Card v. Intuit, was filed today in federal court in San Francisco. The plaintiffs are businesses located in California, New York and Florida that use QuickBooks Pro for their accounting and other data storage purposes.

Juan Loredo, owner of plaintiff AGCJ, Inc., operates a bar called the Vinyl Room in Burlingame, California. On Sunday, December 16, 2007, he opened his QuickBooks program and received the software update from Intuit. Intuit has caused every computer users worst nightmare, stated Mr. Loredo. My company lost its invoicing, sales reports, inventories, day to day working files, pictures, and other files containing financial information. The files lost represent hundreds of hours of work.

As weve described in the Complaint, just as many QuickBooks users were trying to close their books for the year, they lost key financial and business information, said plaintiffs co-counsel Jim Quadra, a partner at Moscone, Emblidge & Quadra, LLP. Through its negligence in transmitting destructive software code and failure to take immediate corrective action, Intuit took what is typically the busiest and most profitable time of year for small businesses, and turned it into a logistical mess.

Although Intuit has finally halted the automatic downloading of the faulty software, Mac users nationwide have each incurred hundreds to thousands of dollars in labor and other cost trying to restore their valuable data, some of which will never be recovered. Todays lawsuit seeks compensation for lost data as well as the time and money spent attempting to recover the lost data, said Michael W. Californian With Recalled Heart Lead Files Class Action Lawsuit to Hold Medtronic Responsible for Cost of Medical Care

SAN FRANCISCO (Business Wire EON/PRWEB ) December 31, 2007 -- Class counsel announced that Rashid Hunter of Fremont, California, filed a class lawsuit against Medtronic Inc., on behalf of all Californians implanted with Sprint Fidelis leads, the wiring that connects a defibrillator to the heart. Due to reports of adverse events and at least five patient deaths linked to breaking defibrillator leads sold under the brand name Sprint Fidelis, Medtronic issued a recall of the product on October 15, 2007. Mr. Hunter seeks an order from the Court holding Medtronic responsible for all diagnostic and medical charges, and any corrective surgical expenses caused by Medtronics faulty device.

I live in constant fear, wondering if my lead will malfunction and kill or cause me severe pain as it has done to others, stated Mr. Hunter. My family also lives in fear that the device will fail and I wont be able to get help in time to save my life. It would be a great relief to me and my family if Medtronic was required to fund a program to monitor the health of every patient with the recalled leads.

The defect is potentially fatal and patients are fearful they may be the next victim, commented Elizabeth J. Cabraser, counsel for Mr. Hunter. Many patients are also concerned whether they will receive the necessary diagnostic and medical care in the years to come, and whether they can afford replacement surgery should their physician recommend extraction of the lead. Todays lawsuit seeks to hold Medtronic responsible for the medical expenses Californians with the recalled wires will incur.

The lawsuit, entitled Hunter v. Medtronic, Inc., was filed in federal court in San Francisco last week. The complaint alleges Medtronic misrepresented the safety of its Sprint Fidelis leads and failed to warn that the leads were prone to breakage. The Medtronic Sprint Fidelis lead has had a significantly higher than expected failure rate that appears in just the first two years after implantation.
