(PRWEB) April 6, 2009 -- Attorney Brian E. Simoneau has successfully challenged the Ignition Interlock Device at both the Registry of Motor Vehicles and Board of Appeal level. On March 24, 2009 in two separate cases, Attorney Simoneau convinced the Registry of Motor Vehicles that the ignition interlock device is unreliable and registers false positive readings. Attorney Simoneau saved his grateful clients from 10 year and lifetime license suspensions.

Melanie's Law requires repeat Massachusetts DUI offenders to have ignition interlock devices installed, for two years, on any vehicles which they own, lease, or operate. Interlock devices are also required for repeat offenders during the term of any hardship license. If an interlock device records a blood alcohol level above a certain set point, the device records a violation. Ignition interlock violations can result ten year or lifetime license suspensions.

Attorney Brian E. Simoneau, an expert in Massachusetts Registry and License Law, has successfully proven, in numerous cases, that the Ignition Interlock Device is unreliable and its readings should not be trusted. Attorney Simoneau has saved countless clients from ten year and lifetime license suspensions due to interlock violations. Attorney Simoneau has convincingly demonstrated that ignition interlock devices are prone to false positive readings and malfunctions. These cheap interlock devices are nowhere near as reliable as the breathalyzers used in police stations. Ignition interlock devices use fuel cell technology to determine alcohol readings. Fuel cells are not alcohol specific and will misinterpret certain chemicals as ethyl alcohol, the type of alcohol in liquor. Ignition Interlock devices are not breathalyzers or scientific test instruments. Instead, they are inexpensive lockout devices which sometimes fail, malfunction, and register false positive readings.

On March 24, 2009, in two separate evidentiary hearings, Attorney Simoneau convinced a panel of Massachusetts Registry of Motor Vehicles officials that Ignition Interlock Device readings should not be relied upon to suspend the licenses of two interlock users. The Registry agreed with Simoneau that the alcohol readings were due to either contamination or malfunction. Accordingly, in two separate cases, a lifetime and 10 year license suspension were avoided. See RMV IVO Hearing 3-24-09, Hearing Nos. 5 & 12. Attorney Simoneau has shown how common products such as protein bars, hand sanitizer, chewing gum, and cough drops have caused false alcohol readings. Massachusetts Registry Lawyer Brian E. Simoneau has thoroughly researched the ignition interlock device, learning how it works and, most importantly, how it does not. Attorney Simoneau attacks the interlock device using several legal arguments which most other lawyers are not even aware of. He has used these arguments to avoid or reverse harsh license suspensions for his clients.

Do not risk a ten year or lifetime license suspension because of an ignition interlock violation when Attorney Simoneau may be able to help. Attorney Simoneau has years of experience dealing with the Massachusetts Registry of Motor Vehicles, the Board of Appeal, and the Courts. In addition to beating the interlock device, Attorney Simoneau has helped countless clients obtain hardship licenses and full license reinstatements even when other lawyers said that nothing could be done.
