On April 3, 2009, Dean Strickland / Never Die Records settled the trademark infringement lawsuit filed on March 5, 2009 against Saint Joseph's University / Hawk Will Never Die Records.
San Antonio, TX (Billboard Publicity Wire/PRWEB ) April 6, 2009 -- Never Die Records / Dean Strickland and Saint Joseph's University confirmed agreement on April 3, 2009 to settle and dismiss the case captioned Ronald Dean Strickland d/b/a Never Die Records v. Saint Joseph's University, Docket No. 2114-SC (Small Claims Court, Precinct No. 2, Montague County, Texas) filed on March 5, 2009. In return for Never Die Records' agreement to dismiss the case and release Saint Joseph's University (SJU) from liability for past actions, SJU has committed not to use any designation containing "Never Die Records" including, without limitation, "Never Die Records," "Hawk Will Never Die Records," and "The Hawk Will Never Die Records." SJU agrees to take immediate steps to cease use of all designations containing "Never Die Records". SJU commits to have completely changed to a new designation within six months at the most.
The company record label 'Never Die Records' was first started by Dean Strickland in the year 2002 as student at Musicians Institute in Hollywood, California, when he created it as a music business class assignment. Dean Strickland used the trade name 'Never Die Records' in commerce as early as July 2002, thus establishing a trademark at that time. Strickland continuously used the mark thereafter, and on August 27, 2002, as the sole proprietor, filed it as a fictitious business name doing business as 'Never Die Records' with the Los Angeles Registrar-Recorder/County Clerk.
Dean Strickland also known as The Hitchhiking Guitarman takes his musical career one ride at a time. Through his hard work, talent and admitted "good fortune," he has safely traversed across Texas, Tennessee and California via the rides of more than 1,000 generous strangers, picking up fans and bolstering a supportive publicity base as he went. He recently completed a disc of original songs that he wrote and recorded on the road called "Hitchhiking Guitarman". Dean Strickland's "Hitchhiking Guitarman" is a country-gospel album with sincerity as its greatest asset.
