Lawsuits Filed Against Starbucks (SBUX) and a Property Managed by Simon Property Group (SPG)

Unusual lawsuit filed by a tenant against a Major Mall Landlord and Starbucks.

Boca Raton, Fla. (PRWEB) January 2, 2008 -- Java TC, Inc. and its owner, Bruce Levy, have filed in Palm Beach Circuit Court (Case ID: 502007CA021877XXXXMB) against Town Center at Boca Raton Trust for breach of contract and defamation.

Java TC. was a franchisee of Gloria Jean's Coffee. The store operated at the same location in Simon's Town Center Mall for approximately 19 years and was one of the top producing stores for Gloria Jean's Gourmet Coffee. The store was extremely popular with the locals and served as many as 25,000 customers a month.

According to the lawsuit, the store closed due to breaches of the lease by the owner of the mall (including that the mall allowed a Starbucks kiosk to be placed 125 feet from the Gloria Jean's Coffee Store in violation of lease provisions) and subsequently published defamatory information.

Starbucks is being sued for trespass and Java alleges that Starbucks' representatives entered its Gloria Jean's Coffee Store to damage and/or destroy Plaintiffs' business.
