District Court Grants Lawyers' Committee's Motion to Intervene in Georgia v. Holder in Defense of Minority Voting Rights

The United States District Court in the District of Columbia has granted the motion filed by the Lawyers' Committee and its co-counsel on behalf of Georgia citizens and organizations in State of Georgia v. Holder. This will enable the Lawyers' Committee and its allies to continue working to prevent implementation of a discriminatory voter verification system and to defend the constitutionality of an important provision of the Voting Rights Act.

(Vocus/PRWEB ) July 9, 2010 -- The United States District Court in the District of Columbia has granted the motion filed by the Lawyers’ Committee and its co-counsel on behalf of Georgia citizens and organizations in State of Georgia v. Holder (Case # 10-1062). This will enable the Lawyers’ Committee and its allies to continue working to prevent implementation of a discriminatory voter verification system and to defend the constitutionality of an important provision of the Voting Rights Act.

Because of Georgia’s history of discrimination in voting, it is one of nine states covered by Section 5 of the Voting Rights Act. As a covered state, Georgia must demonstrate to the Department of Justice (DOJ) or the District Court of the District of Columbia that any changes to its voting procedure or practices are nondiscriminatory before Georgia can implement the changes.

Prior to the November 2008 election, Georgia Election Protection and the Lawyers’ Committee learned that Georgia was informing its counties not to accept the registration of voter applicants who showed up as alleged “non-citizens” in the Department of Drivers Services database unless and until those citizens provided proof of citizenship. The purported non-citizen list turned out to be riddled with errors. Because Georgia implemented these new procedures without seeking federal preclearance, the Lawyers’ Committee and its partners filed suit in federal court in Georgia to block their implementation in Morales v. Handel (Case # 1:08-cv-3712). Subsequent to the filing of the Morales case, Georgia submitted the procedures to DOJ and DOJ objected to them on the ground that they had a discriminatory effect upon minority voters.

Having failed to get preclearance from DOJ for the procedures at issue in Morales and other voter verification procedures, Georgia now seeks preclearance from the District Court in the District of Columbia. Georgia has also made the alternative claim that if the court denies preclearance, Section 5 is unconstitutional as it applies to Georgia.

The Lawyers’ Committee is co-counseling with the American Civil Liberties Union (ACLU) Foundation, the ACLU of the Nation’s Capital and the ACLU of Georgia in representing Tyrone Brooks, the Georgia Association of Black Elected Officials, Edward O. Dubose, the Georgia State Conference of the NAACP, Helen Butler and the Georgia Coalition for the People’s Agenda.

CCA Pays Over $22,000 to American Correctional Association to Claim “Stamp of Approval” at Five Private Prisons

On July 9, private prison firm Corrections Corporation of America (CCA) announced that five of the company’s prisons had been recommended for re-accreditation by the American Correctional Association (ACA), which CCA described as a “stamp of approval.” CCA did not mention that it had paid over $22,000 for those five accreditations, that CCA employees serve as ACA auditors, that CCA is a major sponsor of ACA events, or that ACA-accredited CCA facilities have experienced major security problems.

Nashville, TN (PRWEB) July 9, 2010 -- On July 9, private prison firm Corrections Corporation of America (CCA) announced that five of the company’s prisons had been recommended for re-accreditation by the American Correctional Association (ACA), which CCA described as a “stamp of approval.”

The ACA, a private non-governmental organization composed of current and former corrections employees, offers voluntary accreditation of detention facilities based on the ACA’s self-created standards. There is no oversight or regulation of the organization beyond its own staff.

It is disingenuous for CCA to describe ACA accreditation as a ‘stamp of approval’ when the ACA, a private organization that sets its own standards, accepts payments and donations from CCA.

The ACA’s president-elect, Davidson County, Tennessee Sheriff Daron Hall, is a former CCA program director, and at least two CCA employees serve as ACA auditors – CCA warden Todd Thomas and company vice president Dennis Bradby.

The ACA provides accreditation services to correctional agencies, both public and private, for a fee. As stated by the ACA, facilities that seek accreditation must “pay an accreditation fee.” The organization relies heavily on such fees. For example, in 2008 the ACA reported receiving more than $3.83 million in accreditation fees – over 40% of the organization’s total revenue for that year. Facilities that fail accreditation can re-apply, and the ACA provides waivers for failure to meet certain accreditation standards.

According to a letter posted on the ACA’s website, effective as of January 1, 2009, the cost of accreditation is “$3,000 per day, plus $1,500 for each auditor on the audit team regardless of the size or type of facility.” Thus, at a minimum, CCA paid $22,500 to the ACA in order to obtain re-accreditation at five of the company’s prisons as announced in CCA’s July 9 press release. Last year, CCA paid at least $63,000 to have 13 of its facilities accredited.

ACA accreditation is based largely on documentation provided by the correctional agency being examined, and whether it has certain policies in place – not necessarily whether it follows those policies in practice. Thus, some ACA-accredited CCA facilities have experienced significant problems despite being accredited. For example, earlier this year two prisoners were murdered at CCA’s Saguaro Correctional Center in Eloy, Arizona, which is ACA accredited; CCA’s ACA-accredited Idaho Correctional Center is presently the subject of an ACLU class-action lawsuit that describes systemic violence condoned by CCA staff; and both Hawaii and Kentucky prison officials removed their female prisoners from the CCA-operated Otter Creek Correctional Center in Kentucky, which is also ACA accredited, following a sex abuse scandal in which six CCA employees were charged with sexually abusing or raping prisoners.

One former CCA employee, Donna Como, who served as an accreditation manager, candidly admitted that she helped falsify documents for an ACA audit. “I was the person who doctored the ACA accreditation reports for this company," she stated in December 2008, referring to her employment at the CCA-operated Southern Nevada Women’s Correctional Facility.

In addition to the tens of thousands of dollars that CCA pays to the ACA for accreditation, CCA is also a major sponsor of the ACA’s biannual conferences. In August 2009, CCA sponsored the main banquet at the ACA’s 139th Congress of Corrections held in Nashville, Tennessee – where CCA is headquartered – and has been a major financial supporter of other ACA events. +

“CCA proclaims ACA accreditation of the company’s private, for-profit facilities as a badge of honor and an indication of the quality of CCA’s services,” said Alex Friedmann, president of the Private Corrections Institute and a former CCA prisoner. “Yet CCA basically buys accreditations by paying tens of thousands of dollars in fees, CCA employees serve as ACA auditors, and CCA is a major financial sponsor of the ACA’s conferences. It is disingenuous for CCA to describe ACA accreditation as a ‘stamp of approval’ when the ACA, a private organization that sets its own standards, accepts payments and donations from CCA. That is simply a stamp of CCA getting what it has paid for.”

The Court found the key portions of the law, Title II of the DC AccessRx Act of 2004, unconstitutional. A three-judge panel unanimously affirmed a 2009 District Court ruling, finding that, since PBMs engage in claims administration for their clients and are regulated exclusively by Federal ERISA law, states and municipalities cannot impose such requirements.

“This ruling from one of the most respected Federal Appeals Courts in the country allows PBMs to continue to work aggressively to reduce the costs and improve the quality of prescription drug benefits for the 200 million Americans they serve,” said Pharmaceutical Care Management Association (PCMA) President and CEO Mark Merritt.

The D.C. law never went into effect, as a result of an immediate injunction issued by a lower court and subsequent Court rulings (case number 04-1082 RMU). The Court specifically rejected a contrary holding relating to a “nearly identical” Maine statute (First Circuit: 429 F. 3d 294(2005), case number 05-1606) issued by another Appeals Court, stating that “in our view the uniform administrative scheme encouraged by ERISA includes plan administrative functions performed by a third party on behalf of an EBP (employee benefits plan).”

Dozens of states have rejected legislation imposing similar requirements on PBMs upon realizing that such proposals inadvertently raise, not reduce, prescription drug costs.

New York, NY (PRWEB) July 9, 2010 -- A Rochester man who was seriously injured in an automobile accident has been awarded a $3.8 million verdict by a Monroe County jury.

Attorneys from the New York law firm of Cellino & Barnes secured the verdict for the plaintiff in the case, Kelvin Seawright v. Omar Crooks and Joe Rambo (Index No. 06/88270), which was tried in Monroe County Civil Court before Judge Ann Marie Taddeo.

The plaintiff, who was 39 years old on the date of the accident, earned his living as a forklift operator with a temporary agency, where he was paid $10.00 per hour. On November 17, 2003, he was a front seat restrained passenger when a car operated by Omar Crooks and owned by Joe Rambo, Jr. struck the back of a stopped SUV on Genesee Street in Rochester. Driver inattention was to blame.

The plaintiff was ultimately diagnosed as having suffered a cervical sprain and later, after having an MRI, it was revealed that he suffered a small annular tear and disc herniation. The plaintiff received 149 chiropractic visits in three years, but was unable to complete treatment because his benefits were terminated. He ultimately returned to work on his own in 2008 as a security guard and was restricted to performing sedentary and light duty work.

"We are very gratified that the jurors carefully reviewed the evidence presented at the four-day trial and returned a verdict that we feel justly compensates our client for the medical bills and lost income he suffered as a result of the driver's negligence," said Richard P. Amico, an experienced trial attorney at Cellino & Barnes, one of the nation's largest personal injury law firms.

According to Amico's co-counsel, Timothy Hedges, the plaintiff was awarded $750,000 for past pain and suffering, $85,000 for past wages from 2003 to 2008, and $3,000,000 in future pain and suffering over the next 30.9 years. I’m not a lawyer but I’ve been in the legal industry for 15 years and it appears to me that the facts surrounding the Gulf Oil Spill are probably going to point to evidence that BP was cutting corners on safety issues and their propensity to value profits over people may well have been responsible for this catastrophic disaster. Now John, what do you think will happen if lawyers don’t step in and determine things like blame, the quantification of loss of business and livelihood? When you say what you said, it frankly leads me to believe that you are being backed by the big business entities and insurance companies that are so anxious to tell us we don’t need lawyers. Instead, they tell us they will take care of everything.“

Speaker went on to say, “and while we’re talking about the BP Oil Spill let’s talk about what BP is doing right now and why I believe every individual that has suffered a loss of livelihood in this disaster does need a lawyer. What we’re seeing is BP attempting to settle with business owners for a fraction of what they will lose this year. If the person consults with a lawyer -- that lawyer is going to have accountants and financial experts involved to quantify future losses and diminution of their businesses as well. BP is not going to volunteer to do that. So John, what do you recommend?”

Speaker stated that her father was killed by a drunk driver when she was 20 years old. “We subscribed to the kind of outdated thinking that frankly, I believe you are purporting in your show -- or at least in the clip I saw. We didn’t think we needed a lawyer. The insurance company would do the right thing. Well John, the insurance company did not do the right thing or anything. My mother raised 5 children and worked everyday as a secretary at a school to keep everything afloat. Do you think that was fair? I don’t. I think that we paid for insurance and the other guy paid for insurance and somebody besides my mother should have stepped up to the plate. But they didn’t John. And if you think that big insurance companies and corporations like BP are going to step up to the plate and do the right thing without lawyers to propel them -- then I really have concerns about you. Either your research is being funded by some of these big insurance companies and corporations or I think you just did some pretty lousy research that lacks a balanced view.”

Speaker did concur that there are some sleazy lawyers out there. She does not dispute that. However, Speaker believes that every industry has their fair share of sleaze.

Speaker believes that many lawyers are unsung heroes and she respectfully asks that Mr. Stossel stop giving unbalanced reports about lawyers. She states, “It’s just not fair and I believe it sometimes keeps victims from getting the help and justice that only a lawyer can get them."

The Sam's Club small business loan pilot will focus on serving Main Street minority, women and Veteran owned small business owners as well as micro-entrepreneurs under the SBA's Premier Outreach Express products such as Community Express, Patriot Express and Export Express loans.

"Access to capital is a major pain point for our members and the small business Main Street community. We believe this pilot program is a step in the right direction to help fuel small business growth and create jobs to stimulate our economy. It's also simple to apply and costs less, which is consistent with our goal to help our members make smart choices and provide superior value," said Catherine Corley, vice president, Membership at Sam's Club.

SFG is one of only 13 approved Small Business Lending Corporations (SBLC) federally regulated by the SBA, and specializes in providing access to credit for Main Street and underserved borrowers. Additionally, SFG offers free online technical assistance and online training courses that specifically target the borrower's weaknesses. The courses even include a "how to" on writing a business plan, complete with a business plan writing template.

"All Lenders are trying to make an impact on Main Street, which includes minorities, women and veterans to help create jobs. Main Street however remains the most difficult underserved market to reach, said Tim Jochner, CEO Superior Financial Group. "Sam's Club together with SBA's premier outreach express loan programs provide both a unique and powerful opportunity to reach and provide capital along with technical assistance and training to increase successful penetration into this underserved space."

Sam's Club members who apply for a small business loan online during the pilot will receive a $100 off the application fee, a 20 percent discount and a 7.5 APR, which is 25 basis point discount. The terms of the loans will remain at 10 years, which is common to help keep monthly payments low. There is no penalty for early repayment. Business memberships cost $35 annually at Sam's Club.

Washington, DC (Vocus/PRWEB ) July 7, 2010 -- On July 1, 2010, the Lawyers’ Committee for Civil Rights Under Law and Dewey and LeBoeuf LLP filed a Motion to Intervene in Shelby County v. Holder on behalf of Mr. Bobby Lee Harris, a former City Councilman for Alabaster, Alabama, a municipality of Shelby County. (United States District Court for the District of Columbia, Civil Action No. 1:10-CV-651) With this lawsuit, Shelby County seeks to invalidate Section 5 of the Voting Rights Act on the alleged ground that Congress acted unconstitutionally when it most recently reauthorized Section 5 in 2006 for 25 years.

Section 5 requires certain jurisdictions in all or parts of 16 states with a history of racial discrimination, like Shelby County, to demonstrate to the federal government that any change it makes to its voting process is nondiscriminatory before the change can be made.

“Section 5 has played a critical role in combating efforts to deny minority voters their rights to equal participation in the electoral process,” stated Jon Greenbaum, legal director of the Lawyers’ Committee for Civil Rights Under Law. “The evidence before Congress about the continued need for Section 5 was overwhelming and we intend to provide this evidence, and additional evidence specific to Alabama, to the court.”

Mr. Harris’s own experience exemplifies the need for Section 5. Mr. Harris, who is African-American, was a City Councilman from Ward 1 of Alabaster, Alabama from 1992-2004. In 2000, despite the Department of Justice’s objections to its redistricting plan, Shelby County incorporated a new, predominantly white development into the historically African-American Ward. During the 2000 elections, the County allowed the residents of the recently added area to vote in their new jurisdiction. Due to the Department of Justice’s earlier denial of pre-clearance, Shelby County later decided not to count their votes in the City Council race. Mr. Harris would have lost if the votes from the predominately white development had counted.

“My own experiences have shown that the preclearance requirements of the Voting Rights Act are needed to protect the rights of African-Americans in Shelby County and elsewhere,” said Mr. Harris. Without it, minority voters will be vulnerable to discriminatory efforts to weaken minority voter participation.”

“The Voting Rights Act is one of the most successful pieces of legislation ever passed by Congress,” said John Nonna, a partner at Dewey & LeBoeuf. “Section 5's preclearance requirement has alleviated discriminatory voting practices not only in Shelby County, but throughout the country.”

Synopsis:

Married illegal immigrant couple, Joyce (Omoni Oboli) and Paul Unanga (Sam Sarpong) have been ordered by the US immigration to leave the country by voluntary departure. A brief background on the term Anchor Baby:

The term, Anchor Baby is not new, at least not in the US. Definition: According to the "Double Tongued Dictionary" Anchor baby: a child born of an immigrant in the United States, said to be a device by which a family can find legal foothold in the US, since those children are automatically allowed to choose American citizenship. In 2008, Philip Nelson, president and founder of the Manhattan Film Festival, envisioned the first and only “Virtual Film Festival.” The lawsuit alleges that personnel of the Tribeca Film Festival and the Tribeca Cinemas were present when Mr. Nelson’s groundbreaking vision was laid out point by point at the Tribeca Cinemas as well as by email as part of his business dealings with Tribeca Cinemas.

His vision became a reality at the 2008 Independent Features Film Festival. The festival included live filmmaker Q & A’s, live festivals events such as after-parties and awards show, as always their signature web-based competition which included real-time chat functionality. Housed at the Tribeca Cinemas, a billboard on their venue featured Independent Features’ slogan “The Viewers Have Spoken!”

Upon learning about Tribeca Film Festival Virtual, Nelson said “I was absolutely devastated.” He continued, “We have put our lives into building a platform that will level the playing field for independent filmmakers. We trusted and looked up to Tribeca as a leader in the industry. Never did I think they would use our time, labor, skill, money, effort, and creativity for their gain.”
