Hundreds in Sderot, Israel Protest Hamas Gaza Terror Rockets, Seek Peace for Children

Hundreds of Sderot and Israeli civilians took to the streets today to demand an end to Hamas terror attacks from Gaza. In a rally organized by the Sderot Media Center, protesters demanded an end to violence and the creation of dialogue and peace for both the children of Sderot and Gaza.

Sderot civilians, Israel youth, university students, and international peace supporters marked the one year anniversary of the Israel Defense Forces Operation Cast Lead and a new decade of peace and hope for Sderot and the world for 2010.

"We stand here today on both sides of the border, with a message of peace between us," said Sderot Mayor David Buskila. "We have released balloons with messages from the children of Sderot who experienced the Qassam rockets, and we want to say to Hamas leaders, who to our dismay continue to rearm, that we come in peace. We are too strong to leave this land, and justice is with us."

The peace rally was coordinated with the Israel Ministry of Public Diplomacy and Diaspora Affairs, WUJS, World Jewish Congress, Im Tirzu and the Sderot Municipality.

The Sderot Israel Peace Rally for Hope was a counter-response to the Gaza Freedom March, which took place in Egypt today.

The Sderot rally featured a number of speakers including the presidential candidate for the 2011 elections in Zambia, the Honorable Dr. Saviour Chishimba, Former Member of Parliament-National Assembly of Zambia and founder of the Zambia-Israel Alliance.

In a recent visit to Sderot, Israel Dr. Saviour Chishimba stated: "Now is the time for Africa to stand up and fight terrorism wherever it emerges. The threat against Israel and the Jewish people is the same threat against all the peoples of the world."

The Sderot Israel Peace Rally began at Kibbutz Nir Am, located between Kibbutz Erez and Nir Am. Leading the protesters were Sderot Mayor David Buskila and Information Minister Yuli Edelstein. Hundreds then marched to Givat Yanchik (Givat Ha'Oranim).

Edelstein said he was concerned by the foreign activists who came to support the Palestinians.

"Some of them are cynical, radical left-wing activists whose world is black and white, where Israel is always in the black, but others don't really understand what's going on and instead of promoting peace and helping the children of Gaza, they are assisting the murderers and terrorists of Hamas," he said.

Following the peace march, the Israel peace activists released hundreds of balloons with messages from Sderot, Israel children to the children of Gaza.

Moshe Amar, a Sderot boy whose home was destroyed in a Hamas terror rocket attack and was visited by US President Barack Obama during his 2008 election campaign, spoke to the peace protesters.

"Try to imagine that everything you love, the things that are supposed to be the most secure in your life - your home and your family are directly terrorized," said Amar. "For almost a year, we were left homeless. To this day, that Hamas terror Qassam attack still traumatizes my family - we will never be the same."

The Israel marchers sang peace songs as they were photographed and interviewed by journalists coming from dozens of nations including the US, UK, France, Israel, Spain, Canada, Brazil, Denmark, Sweden, Japan, China and Russia.

"I believe that these people bring a message of peace. The children of Sderot have sent messages to the children of Gaza. Israel doesn't want war; it wants to live in peace with its neighbors - the launching of rockets into Israel must cease," said a Zambian member of parliament.

"We come to Sderot with a message of peace, one year after the war," Edelstein said. "Sadly, the shooting continues, but we seek peace."

Israel Prime Minister Benjamin Netanyahu and Finance Minister Yuval Steinitz submitted for Cabinet approval, an aid package for Sderot and the communities in the area adjacent to the Gaza Strip. The basket of benefits is worth approximately NIS 190 million. Additionally, approximately NIS 150 will be invested in the structural reinforcement of educational institutions in follow-up of previous decisions.

The decision was formulated by Prime Minister's Office Director-General Eyal Gabai and Finance Ministry Budget Director Udi Nisan and includes a series of benefits in the infrastructures, education, social welfare and employment. The goal of the decision is to continue strengthening the communities in the area in order to provide stability, increase social and civil strength and improve local authorities' and residents' ability to cope.

Local Sderot residents and businesses will continue to receive local rate discounts albeit in a reduced format. Given the improved security situation, it will stand at 35 percent for residences and 25 percent for factories and businesses.

Local authorities will also receive special grants in order to deal with the consequences of the security situation.

Sderot, Israel will receive NIS 9 million, other local communities NIS 6 million. This is in accordance with the decision's underlying basis, that of changing the balance of Government investments in the area from current budgets to regional infrastructures and development, reports the Israel News Agency.

The activity of five centers that offer psychological and social services will continue on their present footing. Emergency medical services for area communities will continue.

NIS 14 million will be invested in building reinforced daycare centers will be built in the communities in the area adjacent to the Gaza Strip. Approximately NIS 140 million will be invested in structural reinforcements at educational institutions in Sderot and the communities in the area adjacent to the Gaza Strip in 2010.

Israel Prime Minister Netanyahu said: "The decision expresses our commitment to the security of the residents in the area adjacent to the Gaza Strip, and to the continuation of normal life amidst prosperity and growth in infrastructures, education and other areas. Concern for the security and welfare of our brothers, citizens of the State of Israel whose communities have served as targets for thousands of missiles fired by Iranian-sponsored terrorist groups, will continue to top our unity government's list of priorities."

"Gaza is not under siege by Israel, it is under occupation by Iranian back Hamas," says Christian Arab Ahmad Ayoub, a 46-year-old shopkeeper from Jaffa.

"Israel provides the civilians of Gaza with tons of food, medical and humanitarian aid on a daily basis while everyone forgets that Gaza has another border - Egypt. Is Gaza under siege by Egypt as well? The warehouses and marketplaces are full. If anything, Hamas been stealing much of this aid and keeps it from the people of Gaza to sell on the black market and create more propaganda against Israel. Hamas does not allow democracy. Hamas and Islamic Jihad treat women as second class citizens. Women have no rights. But the biggest problem is that Hamas teaches hate, while the Jews act for peace. The Jews have every right to defend their children against Jihadist holy war terror attacks."

"On September 12, 2005, the last Israeli soldier left Gaza in a unilateral peace move," said Avi Levy, a student from Tel Aviv University.

"What Israel got in return from leaving Gaza was not peace but rather 12,000 terror rockets. Hamas does not seek land. This is not a dispute over territory. Hamas wants every Jew and Christian dead. They see us as "infidels" - no different than those who attacked New York and Washington during 9/11 and those Islamic terrorists who attacked London, Turkey and Paris with bombs. We need moderate Muslims to reach and reason with their brothers who are murdering innocent children and creating a disaster for the people of Gaza."

Alex & Gaxiola Legal Team Files Bold Motions to Disqualify Maricopa County Attorney's Office in Criminal Cases Pending in Superior Court

In separate filings on behalf of multiple clients, Richard Gaxiola moves to have County Attorney dismissed from prosecution of cases due to alleged conflict of interest and impropriety

Phoenix, AZ (Lexis Nexis/PRWEB ) December 31, 2009 -- In motions filed this month with the Superior Court of the State of Arizona, attorneys from the Phoenix-based law firm Alex & Gaxiola moved to disqualify the Maricopa County Attorney's Office (MCAO) from prosecuting multiple clients facing criminal charges in Phoenix.

In the firm's case, State of Arizona v. Robert Eugene Cole (Case No. CR2009-006715-001 DT) and in other cases involving similar issues, highly regarded Phoenix attorney Richard Gaxiola filed defense motions last week to disqualify the MCAO on the grounds that the MCAO's recent pursuit of criminal charges against several active and retired Maricopa County Superior Court judges created a prosecutorial conflict of interest.

Earlier this month, prosecutors working for Maricopa County Attorney Andrew Thomas charged the county's presiding criminal court judge, Gary Donahoe, with three felonies, including bribery. The MCAO has also alleged violations of the RICO Act by current and former county judges they claim are part of a "criminal enterprise." Meanwhile, deputies working for controversial Maricopa County Sheriff Joe Arpaio - a well-known ally of Thomas - visited the homes of several members of the court staff in what the employees perceived as an attempt at intimidation.

"It appears that there is no end to the MCAO's intent on bringing public distrust against our judiciary," said Gaxiola, whose firm handles a wide range of litigation in Arizona. "Clearly, the appropriate procedure is to disqualify the MCAO from any further prosecution and allow the federal complaint and Maricopa County complaint to run their legal course. This would ensure the reinstatement of the public's trust in our judiciary and Arizona criminal justice system."

A flurry of recent legal activity from the defense bar led Arizona Supreme Court Chief Justice Rebecca White Berch to issue Administrative Order 2009-124 on December 23rd, a unique order that appointed retired Arizona Chief Justice Ruth V. McGregor as a Special Master to oversee the administration of all matters arising from the MCAO controversy, including the motions to disqualify that have been filed by Gaxiola and other defense attorneys.

Online Auto Insurance Urges Drivers to Protect Against Uninsured Motorists

Unfortunately, there are motorists who take the risk of driving uninsured and even less fortunate are the individuals who are involved in collisions with these drivers; protection may be available.

Exceptions include the use of electronic communication devices by law enforcement officers for on-duty purposes, as well the use of permanently installed and approved communication devices by commercial vehicle drivers. The law does not apply when the driver must communicate with emergency personnel to report an emergency situation, or if normal traffic is obstructed and the driver has the car stopped with the transmission in neutral or park.

Example: If a homeowner owes $200,000.00 dollars to Bank A on their first mortgage, and $100,00.00 dollars to Bank B on their second mortgage and/or equity line of credit also known as a HELOC.

The property’s fair market value is $175,000.00 dollars and is sold for this price.

In most cases, Bank A forgives all of the remaining balance. Then Bank B forgives $90,000.00 dollars but asks homeowner to sign an unsecured promissory note for the outstanding balance of $10,000 dollars.

This is a win win situation, because nine out of ten times the new note is at 0% interest which is much less than the original note of $100,000.00 dollars and there will be no Foreclosure judgment entered against the homeowner even if the homeowner never pays this new note on the property. The new note is unsecured and the property was sold without having to be foreclosed on.

To make matters ever more clear; if the property is already sold and if there were a foreclosure filed it would have been filed by the first mortgage and not the second mortgage.

In summary what is better, being sued by two mortgage companies for $300,000.00 dollars or an unsecured mortgage for $10,000.00 Dollars? Maybe the $10,000.00 dollar unsecured note is a better option if you were to default.

Is the new unsecured note is a legal contract?

This is what the most argue all the time, of course it's a legal contract, but so were the previous promissory notes. Which in most cases is a HELOC that most lenders had language in the note stating that the HELOC note could be with or without collateral, meaning that it could even survive Foreclosure and become a unsecured debt just like a credit card, which is what a HELOC essentially is, a credit card secured by a piece of property nothing but that.

Tax Consequences in a Short Sale:

This is also another myth. Most do not realize that the taxes in a Short Sale are no different than in a Foreclosure. If the property is taken in a Foreclosure, the court Sale in most cases will usually sell for less than Fair Market Value. This makes the situation worse for the Borrower and for the Mortgage Company. Ultimately the whole neighborhood will suffer.

If the property is the borrowers principal residence there may or may not be any taxes owed on a Short Sale. Please see The Mortgage Debt Relief Act of 2007. And IRS Publication 4681,

In every Short Sale situation Albert Stimer has come across, and it is hundreds, He has never had an attorney advise any of his clients not to sign an unsecured promissory note for a fraction of the original note and risk a potential deficiency judgment after Foreclosure. As said above, it is a win win situation.


Advice to Homeowners:

Always interview the agent or broker before hiring them. Ask for written references and experience.

By no means is a Short Sale an easy process. This is a one shot deal. There is not any room for mistakes.

Unfortunately there are a lot of amateurs in this market trying to do Short Sales and are not successful at getting them approved. As mentioned, this is a one shot deal and if submitted to the lender incorrectly it could cost you the Short Sale of your property. There are a lot of good people going through very difficult financial times and unfortunately there are many amateurs taking advantage of these people. Don’t let that be you.
