Californian With Recalled Heart Lead Files Class Action Lawsuit to Hold Medtronic Responsible for Cost of Medical Care

SAN FRANCISCO (Business Wire EON/PRWEB ) December 31, 2007 -- Class counsel announced that Rashid Hunter of Fremont, California, filed a class lawsuit against Medtronic Inc., on behalf of all Californians implanted with Sprint Fidelis leads, the wiring that connects a defibrillator to the heart. Due to reports of adverse events and at least five patient deaths linked to breaking defibrillator leads sold under the brand name Sprint Fidelis, Medtronic issued a recall of the product on October 15, 2007. I live in constant fear, wondering if my lead will malfunction and kill or cause me severe pain as it has done to others, stated Mr. Hunter. My family also lives in fear that the device will fail and I wont be able to get help in time to save my life. It would be a great relief to me and my family if Medtronic was required to fund a program to monitor the health of every patient with the recalled leads.

The defect is potentially fatal and patients are fearful they may be the next victim, commented Elizabeth J. Cabraser, counsel for Mr. Hunter. Many patients are also concerned whether they will receive the necessary diagnostic and medical care in the years to come, and whether they can afford replacement surgery should their physician recommend extraction of the lead. Todays lawsuit seeks to hold Medtronic responsible for the medical expenses Californians with the recalled wires will incur.

The lawsuit, entitled Hunter v. Medtronic, Inc., was filed in federal court in San Francisco last week. The complaint alleges Medtronic misrepresented the safety of its Sprint Fidelis leads and failed to warn that the leads were prone to breakage. The Medtronic Sprint Fidelis lead has had a significantly higher than expected failure rate that appears in just the first two years after implantation.

The number of entrants to the 2007 World Series of Poker declined for the first time in 15 years, although the decrease was not a result of declining popularity. WSOP executives announced early in the year that they would not be accepting registrations from online satellite tournaments because of the newly passed Unlawful Internet Gambling Enforcement Act (UIGEA). This was the main cause in the drop in numbers and only one of many very significant negative ramifications of the new US law.

The Interactive Media Entertainment and Gaming Association (iMEGA) filed a lawsuit against the US Treasury Department in 2007 over the UIGEA proposed regulations. The papers filed in New Jersey federal court were not taken seriously by the media at first, but now the case is seen as the last hope for the Internet gambling industry. The judge was scheduled to rule in November, but still no judgement has been rendered. If the judge rules in favor of iMEGA the UIGEA will be temporarily restrained.

Previously, the tribe could only feature bingo-style slot machines and poker. Florida House speaker Marco Rubio, furious over the deal, argued the compact to be invalid without legislative ramifications, and ultimately sued the Governor. The compact followed other very big news from the Seminoles when they finalized the purchase of the Hard Rock chain of hotels and casinos across the world. The deal made the Seminoles the most prosperous business entrepreneurs of all Native American tribes.

#3 Venetian Opens Largest Casino Ever in Macau, China
The new Venetian Macau, which opened in September by US firm Las Vegas Sands Corporation, was built on expectations of becoming the largest casino in the world. The casino has not let down investors and the bullish predictions have become reality. In the first weekend, the casino saw crowds of over 100,000 people per day.The new mega-casino-resort resides on the tiny island of Macau in China, a place which surpassed Las Vegas as gambling capital of the world in 2007. Other companies have promised to follow the Venetian example and Macau is expected to soon be the ultimate adult playground.

The US proved its international power in the WTO case and made some analysts believe the US can do whatever it wants by creating very fine print.

While all stories could not make the top ten most popular and influential list of 2007, many stories may have deserved to be there. The arrests and settlements of Neteller executives in the US was huge news. The proliferation of pop culture betting was telling of today's society. On Sunday, December 16, 2007, he opened his QuickBooks program and received the software update from Intuit. Intuit has caused every computer users worst nightmare, stated Mr. Loredo. My company lost its invoicing, sales reports, inventories, day to day working files, pictures, and other files containing financial information. The files lost represent hundreds of hours of work.

As weve described in the Complaint, just right as many QuickBooks users were trying to close their books for the year, they lost key financial and business information, said plaintiffs co-counsel Jim Quadra, a partner at Moscone, Emblidge & Quadra, LLP. Through its negligence in transmitting destructive software code and failure to take immediate corrective action, Intuit took what is typically the busiest and most profitable time of year for small businesses, and turned it into a logistical mess.

Although Intuit has finally halted the automatic downloading of the faulty software, Mac users nationwide have each incurred hundreds to thousands of dollars in labor and other cost trying to restore their valuable data, some of which will never be recovered. Todays lawsuit seeks compensation for lost data as well as the time and money spent attempting to recover the lost data, said Michael W. Sobol of Lieff Cabraser Heimann & Bernstein, LLP, and plaintiffs co-counsel.

The proposed class consists of all individuals and entities whose files or data became inaccessible or were damaged, corrupted, or lost, whether temporarily or permanently, as a result of opening QuickBooks and receiving Intuit's December 2007 faulty code. The complaint asserts claims of negligence, strict products liability, trespass to chattels, breach of implied warranty and unfair business practices. Plaintiffs seek for themselves and all class members compensatory and other damages.
